EU Commission clamps down on influencers' unfair commercial practices

With a press release of yesterday, 17 October 2023 (see here), the European Commission stated that in the coming weeks, together with the national authorities of the Consumer Protection Cooperation Network, it will screen online posts to identify testimonials and endorsements that mislead consumers.

The result of this social media sweep will feed into the Digital Fairness fitness check that helps assess whether new legislation is necessary to make digital markets as safe as offline markets.

The Commission, in fact, noted that influencer marketing has now become a pillar of the digital economy, with an estimated global value of €19.98 billion in 2023.

The European Commission also launched the platform Influencer Legal Hub, which contains information on EU legislation in the area of fair commercial practices to help influencers and creators comply with the rules.
