ASSESSMENT

We assist our clients in carrying out IP due diligences, e.g. in preparation for a transaction, to assess their own IP assets or the IP assets owned by, or licensed to, target companies or businesses.

PROTECTION

We help our clients to check if their IP assets are adequately secured, e.g. through the appropriate registrations. We advise them on how to better protect their IP assets in order to prevent infringement of the same. We assist them with the drafting of documents necessary to keep sensitive commercial information secret (NDA, internal policies etc.). More generally, we assist clients in implementing the technical and contractual measures required to protect trade secrets and source codes.

ENFORCEMENT

We have a very long experience in enforcing IP rights before courts of law and other bodies. Our partners have led high profile court cases, many of which have formed current Italian case law on issues such as know-how infringement, protection of trademarks against dealers not belonging to the IPR holder’s selective distribution network, the limits of the Italian Bolar clause, copyright protection of design works and of architectural works, protection of databases, ISP’s and content delivery network liability, copyright protection of software, use of trademarks on replica spare parts.

In some cases, IP rights protection begins with customs monitoring programmes that we manage on behalf of our clients to detect and block counterfeit products at Italian customs.

We also assist clients in the identification of the infringers of their rights.

EXPLOITATION

We have extensive experience in drafting and negotiating transfer agreements, licence agreements and other commercial agreements for the exploitation of IP economic rights.

PROSECUTION

We prosecute trademarks and designs and register copyrights, where available. We coordinate with the most suitable patent agents for patent prosecution.

Where applicable, we suggest clients and assist them in applying for funds offered by national and international offices (i.e. EUIPO) in order to reduce registration costs.
