We have extensive experience in trademark infringement proceedings, including in illicit parallel import cases, against grey market resellers and against intermediaries (e.g. online sales platforms, ISPs and payment providers).

ANTI-COUNTERFEITING

We handle customs monitoring programs to have infringing goods halted at Italian borders, and we liaise with the fiscal police to have infringing goods seized at markets and/or trade fairs.

PROSECUTION & STRATEGY

We help clients developing a trademark portfolio. We assess strengths and weaknesses of their perspective trademark applications, through priority searches and conflict evaluations, and recommend for application only trademarks that are really worth registering. We then file and prosecute the relevant trademarks, and/or challenge conflicting competitors’ applications, before EUIPO and/or the Italian Patent and Trademark Office.

COMMERCIAL AGREEMENTS

We draft and negotiate commercial agreements for the exploitation of brands and the production and commercialisation of the relevant products, including NFTs, design and consultancy agreements, trademark and/or design licence and assignment agreements, distribution, agency and franchising agreements, supply and sub-supply agreements.

E-COMMERCE

We assist clients in setting up their e-commerce portal, including by drafting the required T&Cs and privacy policies and by ensuring compliance of the entire website with advertising, data protection and consumer law.

ADVERTISING

We check the client’s advertising campaigns to ensure compliance with the applicable laws. We also assist clients in procedures before the Italian Advertising Authority and the Italian Competition Authority.

DATA PROTECTION

We provide advice as to the compliance with the applicable laws of the data processing put in place by clients, e.g. in respect of their marketing campaigns. We also assist clients in data protection proceedings, both in court and before the Italian Data Protection Authority.
